What Is TDIU?

Total Disability based on Individual Unemployability (TDIU) is a VA benefit that allows veterans who cannot maintain substantially gainful employment due to their service-connected disabilities to receive compensation at the 100% rate — even if their combined schedular rating is less than 100%.

TDIU recognizes that a veteran rated at 70% combined may be just as unable to work as a veteran rated at 100%. The benefit closes that gap.

TDIU Eligibility Requirements

There are two paths to TDIU: schedular and extraschedular.

Schedular TDIU (38 CFR § 4.16a)

You meet the schedular threshold if:

  • One condition rated at 60% or higher, OR
  • Combined rating of 70% or higher, with at least one condition rated at 40% or higher

Plus: Your service-connected disabilities must prevent you from securing and following substantially gainful employment.

Example: Schedular TDIU Eligibility

Veteran has: PTSD 70%, Tinnitus 10%, Migraines 30%
Combined rating: 80%
Single condition at 40%+: Yes (PTSD at 70%)
Combined at 70%+: Yes (80%)
Cannot maintain employment due to PTSD symptoms
Result: Meets schedular TDIU threshold

Extraschedular TDIU (38 CFR § 4.16b)

If you do not meet the schedular thresholds but your service-connected disabilities still prevent employment, you can apply for extraschedular TDIU. This requires referral to the Director of Compensation Service for a decision.

Extraschedular TDIU is harder to get but not impossible — especially with strong medical evidence and employment history showing an inability to work.

What "Substantially Gainful Employment" Means

Compensation at the 100% Rate

TDIU pays the same monthly amount as a 100% schedular rating. For a single veteran with no dependents, that's over $3,900/month in 2026. With dependents, it can exceed $4,500/month.

Additional Benefits

TDIU veterans are eligible for many of the same benefits as 100% schedular veterans, including CHAMPVA healthcare for dependents, Chapter 35 Dependents' Educational Assistance, and property tax exemptions in many states.

Can I work and still receive TDIU?
Yes, in some cases. Marginal employment (earning below the federal poverty level, roughly $15,060/year) does not disqualify you. Protected or sheltered work environments also do not count against you. However, substantially gainful employment will end TDIU eligibility.
Is TDIU permanent?
Not automatically. However, if you've been on TDIU for 20+ years, it becomes protected. If your underlying ratings have been static for 5+ years, they are also protected from reduction. You can request a permanent and total (P&T) determination.
What's the difference between TDIU and 100% schedular?
The monthly pay is the same. However, 100% schedular veterans have slightly more protections and access to some state-level benefits that specifically require a 100% schedular rating. TDIU veterans may also be subject to employment reviews.
Can I get TDIU with a 50% rating?
Not through schedular TDIU (you need 60% single or 70% combined). However, you can apply for extraschedular TDIU under 38 CFR § 4.16b if your disabilities genuinely prevent employment. This route is harder but possible.
Do I need a lawyer for TDIU?
